Const., art. VIII, §§ 1 and 2), and the Open Records Act (Tex. Gov't Code Ann., tit. 5, §§ 552 and 553). The Office of Texas Attorney General, Ken Paxton, has filed suit in Dallas County District Court against the municipality of Lewisville and the city manager, Lisa Huval. The suit alleges that Lewisville did not follow the Texas Open Meetings Act (TOMA) during public hearings regarding the Pinderloy Park development. The suit was filed after Mark Hayes, a former Lewisville City Council member who voted against that development (his term has ended), filed a complaint with Paxton's office. At issue is whether the city clerk communicated to all Council members that there was no quorum before two members went into an executive session during which they decided to approve the development over loud public opposition . While TOMA does not require quorums be taken every time the Council adjourns to executive session, it does require that the number of members present, or a lack thereof, be communicated to all members. Paxton alleges that despite Gordon Dickson, Lewisville city manager since April 2013, being fully aware of TOMA provisions regarding quorums , the city clerk failed to inform Council members that there was no quorum before two Council members entered into an executive session at which time they approved the Pinderloy Park development . Paxton alleges in his lawsuit against Lewisville and Huval that the failure to include all Council members prior to entering into executive session violated TOMA requirements. The Toma has been in effect in Texas since 1977. The law requires that when Council members enter into executive session, they shall provide written notice of it to all other members and report back to the public before each session begins. If no such notice is given, then the number of members present is insufficient and no action can be taken . After two Council members entered into an executive session late in the evening of February 2, 2014 at which time they approved the development of Pinderloy Park over loud public opposition, Paxton alleges that Lewisville violated TOMA requirements. cfa1e77820
